Terms and Conditions
These terms govern the supply by Pooltronics Pty Ltd of Dolphin domestic and commercial robotic pool cleaners, genuine spare parts and accessories, assessments, servicing and repairs, and any installation expressly agreed with you. Read them with your accepted quote, order confirmation and product warranty documentation.
Your consumer rights:
Nothing in these terms excludes, restricts or modifies a right, guarantee or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation. Where a provision conflicts with such a right, that right prevails.
1. About these terms
"Pooltronics", "we", "us" and "our" mean Pooltronics Pty Ltd (ABN 40 626 440 186). "You" means the person or business purchasing our goods or authorising our services. "Goods" include domestic and commercial Dolphin robotic pool cleaners, genuine spare parts and accessories; "services" include assessments, servicing, repairs and any installation expressly agreed in writing. "ACL" means the Australian Consumer Law in Schedule 2 to the Competition and Consumer Act 2010 (Cth).
These terms apply to a transaction when supplied to you before you agree to it. An enquiry is not an accepted order. If you act for a business, you must be authorised to place the order or approve the work. Specific terms in a quote or service agreement take priority only where both parties agree to them; neither those terms nor these terms override rights that cannot lawfully be excluded.
2. Quotes, orders and pricing
Prices are in Australian dollars. Prices displayed to consumers include GST where applicable. Your quote or order confirmation will identify the goods or services, the total price and any freight or other charges. Stock availability and any quote expiry date will be confirmed before acceptance. Prices may change for future orders, but an accepted price will not change without your agreement.
An order is accepted when Pooltronics confirms acceptance. Tell us about your requirements before ordering, including the intended pool, operating environment and any particular purpose. If we identify an error in pricing or specifications before acceptance, we will explain it and obtain your agreement to the corrected details before proceeding.
If an accepted item becomes unavailable, we will notify you and discuss a revised delivery date, a suitable substitute you approve or cancellation and a refund for that item. If circumstances outside our reasonable control affect supply, we will explain the likely impact and available solutions. We will not substitute products or impose additional charges without agreement.
3. Payment
Unless another arrangement is agreed in writing, payment for goods and services is due before or at delivery or collection. Bank transfers and cheques are treated as paid when funds have cleared. Pooltronics does not add a surcharge for credit-card payments. Any deposit or agreed account payment period will be stated in the quote, order confirmation or invoice.
Payment terms already agreed cannot be changed unilaterally. If payment is overdue, we will contact you about the outstanding amount and a reasonable opportunity to resolve it. Any suspension of further supply or work must be proportionate, notified where practicable and lawful. Interest, recovery charges or special credit conditions will apply only where separately agreed in advance and legally enforceable; these terms do not impose an automatic interest rate or make future invoices immediately payable.
4. Delivery and collection
Pooltronics covers standard delivery to your nominated address for orders over $250 within metropolitan Melbourne, excluding optional insurance. Charges for other deliveries will be confirmed before acceptance. If you choose to engage your own carrier, you are responsible for that carrier’s charges. Confirm the delivery address, access arrangements and any collection instructions when ordering.
Delivery and collection dates are estimates unless a specific date is agreed. If freight delays, parts shortages or other circumstances outside our reasonable control affect supply, we will notify you and work towards an appropriate solution. Such circumstances do not automatically excuse our obligations or remove your rights to a remedy where delivery is not made within the agreed time or a reasonable time.
Ownership of goods passes when the purchase price has been paid in full. For delivery arranged by Pooltronics, responsibility for loss or damage in transit remains with us until delivery to you or your authorised recipient. Contact us promptly about damage, shortages or non-delivery so we can investigate. Prompt reporting is requested for practical reasons and is not a time limit on statutory rights. Any arrangement involving your own carrier remains subject to applicable law.
5. Product suitability and spare parts
Before purchase, tell us your pool size, surface, shape, operating conditions and whether use is domestic or commercial. Identify any special cleaning requirement or result you need. We will use the information provided to advise on model suitability. These terms do not require you to give up reliance on our advice, descriptions or recommendations, or on guarantees that apply by law.
When ordering spare parts, provide the Dolphin model, serial number, existing part number and clear photographs where available. Parts can vary between model generations and configurations. We will assist with compatibility based on the information supplied. If we supply an incorrect or misdescribed part, your statutory remedies remain available; selecting a part yourself does not automatically remove those rights.
Use, install and maintain goods in accordance with the manufacturer’s safety and operating instructions, including water-chemistry requirements. Installation, setup or commissioning by Pooltronics is included only if expressly stated in the accepted quote, together with its scope and cost. Any required site access or approvals will be agreed before that work. Electrical installation or specialist repairs must be performed by appropriately qualified people. Damage actually caused by misuse or incorrect installation will be assessed on its facts.
6. Assessments, servicing and repairs
Provide the cleaner model, serial number, fault symptoms and relevant repair history. For warranty assistance, supply a receipt or other reasonable evidence of purchase where available. Before sending equipment, contact us to confirm which components are required and the assessment and transport arrangements.
Any chargeable inspection, diagnostic assessment or freight charge must be disclosed and agreed before it is incurred. Authorising an assessment does not authorise a repair. There is no assessment charge for providing a remedy where the ACL requires that remedy to be free; a fee for an assessment that finds no covered fault will apply only if disclosed in advance and lawful.
Following assessment, we will explain the recommended work and provide a repair quote or obtain an agreed spending limit. We will not carry out chargeable repairs beyond your approval. If additional work is required, we will explain the change and seek approval before proceeding. Any required notice about potential loss of stored data or the use of refurbished replacement goods or parts will be provided before accepting equipment for the relevant repair.
If you do not proceed with a quoted repair, only assessment work and other charges already disclosed and agreed are payable, subject to statutory rights. Repair time depends on the fault, parts availability and workshop workload. We will provide an estimated turnaround after assessment and advise you of significant changes. Servicing and repairs remain subject to guarantees that apply to the work and supplied parts.
We will take reasonable care of equipment in our possession and notify you when it is ready for collection or agreed return delivery. Storage charges require separate disclosure and agreement; none arise automatically under these terms. Uncollected equipment will be handled only in accordance with applicable law, including required notices, time periods and procedures.
7. Australian Consumer Law
Where the ACL applies, goods must satisfy guarantees including acceptable quality, matching their description and fitness for a particular purpose made known to us. Services must be provided with due care and skill and meet applicable fitness-for-purpose and timing guarantees. Commercial customers can also qualify as consumers under the ACL; business use alone does not remove these rights.
For a more information please visit the ACL website https://consumerlaw.gov.au/
8. Product warranties
Manufacturer warranties and any separate written warranty supplied by Pooltronics are additional to your statutory rights. The applicable period, coverage and claim requirements are those supplied for the particular product at purchase. Different cleaners and parts may have different coverage; these terms do not impose a universal 12-month limit or create a separate blanket warranty. Consumer guarantees can continue after a written warranty expires.
Contact Pooltronics with your purchase details, cleaner model, serial number and a description of the issue. We may reasonably assess the goods to determine the fault and appropriate remedy. For goods purchased from Pooltronics, you may seek any remedy for which we are responsible directly from us; we will not require you to deal only with Maytronics or another authorized supplier.
A written warranty may exclude normal wear or damage caused by misuse, incorrect installation, unsuitable operating conditions or unauthorised alterations, according to its terms. Such exclusions do not remove statutory rights. We will consider the cause of the particular fault; or the expiry of a warranty does not automatically extinguish an unrelated claim.
9. Returns and cancellations
Faulty, incorrect or misdescribed goods
Contact us about faulty, incorrect or misdescribed goods so we can arrange assessment and the remedy required by law. Original packaging is not a condition of a statutory claim. A receipt or other reasonable proof of purchase may be provided. The change-of-mind time limit, freight deductions and handling charges below do not apply to statutory remedies.
Where a fault is confirmed, we will reimburse reasonable return costs. Where the size or nature of faulty goods makes return significantly costly, we will arrange collection as required by law. If no fault is found, any proposed assessment or transport charge must have been disclosed beforehand and be lawful. A statutory refund will not be replaced with store credit without your agreement.
Change of mind
Unused goods in their original packaging may be returned or exchanged within 10 days of receipt under Pooltronics’ change-of-mind policy, with the purchase price refunded less delivery charges. Contact us to arrange the return; you pay change-of-mind return freight. Exceptions for special-order or superseded items must be disclosed before purchase. Altered, used or customer-damaged items do not qualify under this voluntary policy, but statutory claims remain unaffected.
Change-of-mind returns after 10 days require our agreement. Any proposed restocking or handling charge and the refund amount will be disclosed before you agree to return the goods. No restocking or handling charge applies to a refund required by law.
Order or service cancellations
Contact us promptly if you wish to cancel an order or authorised service. Any cancellation charge must have been agreed in advance, be reasonable and reflect unavoidable costs after reasonable steps to minimise them. We will explain any work completed or costs incurred and refund any balance due. Statutory rights to cancellation or a refund take priority.
10. Website information and use
We aim to provide accurate product descriptions, specifications, prices and availability. Confirm current model details with us before ordering. General troubleshooting and installation information cannot determine every fault or replace an assessment where one is needed. This does not disclaim responsibility for our representations or advice, or remove rights arising from inaccurate or misleading information.
Use this website lawfully and do not interfere with its security or misuse enquiry forms. Pooltronics website content and third-party trademarks, photographs and product materials remain subject to their respective intellectual-property rights. Obtain permission for reproduction where required by law. Purchasing goods does not grant a licence to use Pooltronics or Maytronics branding or imply an authorised dealership.
External websites have their own terms and privacy practices. Information supplied to Pooltronics is handled to respond to enquiries and administer orders, assessments and services, subject to applicable privacy law. Providing an enquiry does not require consent to unrelated marketing.
11. Questions and disputes
For a concern about a purchase, delivery, installation expressly agreed with us, or repair, contact Pooltronics Pty Ltd at 1 Lester Drive, Altona North VIC 3025, on 1300 815 066 or at info@pooltronics.com.au. Include your order or repair details, the issue and the outcome you seek. We will consider your complaint and work towards a fair resolution. You remain free to seek assistance from Consumer Affairs Victoria or another appropriate regulator, tribunal or court.
12. Changes and governing law
We may revise these terms for future transactions. The version supplied and agreed when a transaction is accepted applies to that transaction unless both parties agree to a change. Updating the website does not retrospectively change an accepted price, payment arrangement or other agreed term, or incorporate new manufacturer policies into an existing contract.
Victorian law and applicable Australian law govern these terms. You retain any mandatory right to bring a claim in another jurisdiction where permitted by law. If a provision is invalid, unfair or unenforceable, it will not be relied on, and the remaining terms continue only to the extent legally possible. No provision requires you to waive statutory notices or remedies.
